So to put a proper cap on all my job drama last week, I have witnessed the most hilarious and dramatic implosion of a company over such a short period of time. A few highlights from this week alone:
-My boss basically admitted in his own contract with this new company he sold asse ts to , he would get a bonus if he got me to sign on as an employee too. Explains MANY things
-I was dis-invited to a leadership meeting at my current/former company, where everyone admitted they had no idea what to do anyways so....meh, I guess
-A final meeting about this whole charade with my boss ended with him telling me “sign this contract with the new company because you have no job here anymore and they don’t want you working here anymore ”
-The plant manager quit in disgust after the previous two bullet points (leaving just two employees still working in the plant)
-Our sister company that is literally next door to us is shut down today due to a wave of covid
-Two of our suppliers and a few of our customers cancelled negotiations for deals that would’ve helped the company due to both myself and the plant manager leaving
-I actually *did* sign an hourly contract with the new company on a two-week by two-week basis with options to be a consultant in the future.....and COMPLETELY shut myself out of staying on with this company.
Man, I did not see any of this happening last week monday, not gonna lie. But hey, I’ve got some interviews and my exit plan scheduled. Now I just need to pass a covid test and I’ll be free and clear of this place by end of day tomorrow.

Wow. Sounds like getting out is the only smart move. In credible that they would use you as a tradeable asset without even consulting you before hand - it makes no sense.

Thanks. Yeah, I have a few exit plans, including the hourly contract work. There’s plenty to do for them, it’s just work I don’t want to do and no one else does either. Kinda boring, but it pays the bills and gets me the hell away from here!

My former employer, where I spent about 9 years in various capacities, and have a pension and two 403bs, has been under bankruptcy protection for about the past year and has been slashing and burning staff ever since the COVID shutdowns started. I’m not a totally disinterested party, but it has been nice to be on the outside looking in during all that, and to also be in an industry that traditionally sees an upswing in demand during economic turmoil and stress.

I’m good now, I have interviews lined up with companies a lot closer to home. I was driving ~75-100 miles each day between commuting and checking in on customers and suppliers. So even a small pay cut might wind up with a net gain. Also that contract is very loose and I actually like it, now that I got a chance to negotiate for myself instead of having it done for me. We even agreed that should I decide to get a new job, the contract is still valid for up to a whole calendar year, so if something comes up I can ask if they have hours/work for me and just get back to it and keep a job of some kind.

Obviously I cannot provide legal advice, so just be careful. Your new employee might not like it if this contract exists while you are employed by it, even if you literally did nothing under the contract. So many things can go wrong here - accusations of trade secret theft, etc. Particularly as skeezy as your current “employer” sounds.

Meh, the whole thing fit on a single sheet of paper and doesn’t have a lot of wiggle room. It does give them a lot of power to fire me, but that’s kinda what I want, to be honest. I made it clear I don’t want to work for them in the long term, and our initial work has made it clear they probably want someone else to sign off on a lot of this work. Nothing in the contract says the contract is voided if I seek employment elsewhere, and likewise there is zero guarantee of work if I decide to end working for them on my end. So if I pull the two-week trigger on my end, I have to accept that that could be it. If I lose the new job after a week and want to come back? They could just as easily say “tough shit, good luck”.
It’s not a perfect contract by a long mile, but it’s also rather cut and dry. I’m not a lawyer by any means, but it’s also not my first rodeo. I do have a lawyer’s opinion on the previous incident so worst case scenario, I’m sure he’d have some strong words about what went down here. I *am* saving all emails and printouts and everything that led up to this contract just in case there was a last minute bait and switch on the contract I missed though
